Comdoktor - ComDoktor - Computerservice & Sales, Inh. Ronny Schulze
1. General
The ComDoktor is a repair service with sales connection of PC technology and entertainment electronics in Bautzen. The contractual partner of the customer is Comdoktor - Computerservice & Verkauf, Ronny Schulze, Steinstr. 41, 02625 Bautzen. The place of fulfillment is, unless otherwise agreed, Bautzen for both parties. The legal status is Bautzen. If the customer is a merchant within the meaning of the German Commercial Code (HGB) or if his place of residence is located abroad, Bautzen is agreed as the court of jurisdiction.
The terms and conditions of the Comdoktor - Computer Service & Sales apply exclusively to contracts between the two parties. If the General Terms and Conditions of the customer differ in whole or in part from this, they will not be contractual, even if they have not been expressly contradicted. This shall not apply if Comdoktor - Computerervice & Verkauf has expressly agreed to deviate from this.
The law of the Federal Republic of Germany.
2. Prices
The calculation is made according to the respective valid price list and any other agreed conditions. All prices include VAT. For business customers, separate prices are subject to agreement.
3. Payment
Unless otherwise agreed, the payment shall be made immediately and in cash, goods deliveries will be made only in advance or cash on delivery. The buyer is responsible for the shipping and handling costs.
4. Payment delay
In the event of a delay in payment, the entire claims of Comdoktor - Computerervice & Verkauf are due. A processing fee of € 5 plus possible bank processing costs and default interest in the amount of 2% above the current discount rate of the Bundesbank shall be due.
5. Reservation of title
All deliveries are subject to retention of title. The delivered goods remain property of the Comdoktor - computer service & sale up to the complete payment. The purchaser assigns all claims arising from the resale of the reserved goods to third parties to Comdoktor - Computer Service & Sales, without which a separate assignment declaration in individual cases is required.
6. Complaint
Complaints are to be reported in writing within 14 days after delivery of the service or delivery of the goods and with presentation of the invoice. The buyer or customer has the right to make subsequent improvements. Comdoktor - Computerservice & Verkauf reserves the right to remove the defect either by rectification or equivalent replacement. If the improvement does not succeed in the second attempt, the buyer or customer can demand a reduction of the price (reduction) or cancellation of the contract (conversion). Additional claims for damages are excluded. The warranty is 24 months for new products. The warranty is 12 months for used goods, including the so-called B-goods.
7. Insolvency / insolvency of the buyer or customer
In the event of a sustained delay in payment, in the case of a check payment, the payment setting by the buyer or customer, or in the event of insolvency or settlement proceedings concerning his assets or the cessation of such proceedings, Comdoktor - Computerservice & Verkauf shall be entitled to immediate payment of all claims against the buyer or customer Without regard for the agreed due date. If such conditions are met, Comdoktor - Computer Service & Sales is also entitled to carry out outstanding services and deliveries only against payment in advance or security services and, if the advance payment or security is not rendered within two weeks without canceling the contract.
8. General liability rules
Comdoktor - Computerservice & Vertrieb is only liable for damages which are based on an intentional or grossly negligent breach of duty by its legal representatives or employees, as long as unsecured properties or contractual obligations are not affected. Comdoktor - Computerervice & Verkauf accepts no liability for data loss and resulting costs.
9. Privacy
The Comdoktor - Computer Service & Sales assures that all data in the computer systems of the customers, which could be viewed during a repair or maintenance, are treated confidentially and in no case passed on. The customer agrees that his data within the framework Of the business relationship are processed and stored electronically. This data will not be passed on to third parties without authorization. The transfer of customer data to a company commissioned by Comdoktor - Computerservice & Verkauf for the purpose of contract processing and settlement is expressly deemed to be unauthorized. The customer is reminded that, in the case of a transmission of data on the Internet, it is not possible to completely rule out the possibility of unauthorized persons gaining access to the transmitted data during the transmission process.
The Comdoktor - Computer Service & Sales deals with all customer data according to the Federal Data Protection Act.
10. Final provisions
Comdoktor - Computerservice & Verkauf reserves the right to change the GTC at any time. The currently valid terms and conditions can be found on our website or, if requested, by fax or post.
Individual agreements, amendments to the contract and amendments shall be made in writing. Should a provision of these terms be or become ineffective or should the conditions be incomplete, the remaining conditions shall remain unaffected. The ineffective provision shall be deemed to be replaced by such a provision which is economically closest to the meaning and purpose of the invalid provision in a legally effective manner.
